Terms of use
By downloading, installing, or using AstroCompass, or by using this website, you agree to these terms. They are short on purpose. If you do not agree, do not use the app or the website. If you are not old enough to enter into this agreement yourself, a parent or legal guardian must review and agree to it for you.
1. Not a navigation instrument
AstroCompass is a stargazing and educational app. It is not a navigation, aviation, marine, surveying, emergency, or safety instrument, and must not be used as one. Headings, positions, altitudes, satellite passes, rise and set times, and every other figure the app shows are estimates derived from your phone's sensors, its clock, its location service, published catalogs, third-party data, and the app's own calculations. Any of these can be materially inaccurate, late, incomplete, or unavailable. Magnetic interference, sensor calibration, device orientation, clock and location errors, atmospheric conditions, and software defects can all affect what you see. Sky Lock corrections apply only after the app reports a successful lock and only while it reports the fix as held. Never rely on the app to find your way, to judge distance or safety, or in any situation where an error could cause harm. Use proper navigation equipment and official sources for that. Do not use the app while driving, piloting, or doing anything else that needs your full attention.
2. Licence
Your licence to AstroCompass is governed by Apple's standard Licensed Application End User License Agreement (the "Apple EULA"). These terms supplement the Apple EULA and govern your relationship with Dead Reckoning Studio LLC concerning the app, its related services, content, and this website. If these terms conflict with the Apple EULA about the scope of the App Store licence or Apple's rights, the Apple EULA controls. Your rights to use the app may end if you materially violate these terms or the Apple EULA. You may not reverse engineer, resell, or redistribute the app or its data packs except as the law or an open-source licence expressly allows.
3. Content and credits
Star positions come from the Hipparcos catalog (ESA), ephemerides from astronomy-engine (MIT licence), satellite orbits from CelesTrak, and photographs from NASA and other credited sources; each object page carries its credits, and the full third-party notices are in the app's About screen. Science facts, Skylore stories, and Nerd Facts are sourced and cited in the app. They are provided for interest and education, not as professional advice. The app, its original software, design, constellation artwork, text, and other original content are owned by Dead Reckoning Studio LLC or its licensors and protected by intellectual-property law. Third-party materials remain the property of their owners and are used under their licences or permissions.
4. Beta builds
Builds installed through TestFlight are pre-release software provided for evaluation and testing. They may contain defects, lose data, change without notice, or stop working when a build expires or the beta ends. Apple and we may receive crash reports, device information, usage information, and tester feedback as described in the privacy policy and Apple's TestFlight terms. Feedback you choose to send us may be used to evaluate, develop, and improve our products without obligation to you. We will not identify you publicly in connection with your feedback without your separate permission.
5. Subscriptions, purchases, and tips
All purchases are made through Apple's in-app purchase system and are subject to Apple's terms and refund policy. Apple processes payment; we do not receive your card or payment-account details. The purchase screen is the definitive statement of price, billing period, any trial, and what is included; if it differs from the general description here, the purchase screen controls.
- Subscriptions, when offered, renew automatically for the period and at the price shown in Apple's purchase confirmation unless cancelled through Apple before renewal. Apple handles charges, renewals, cancellations, price-change notices, and refunds under its policies. Manage or cancel any time through your Apple Account subscription settings; Apple's current cancellation instructions are on its support site. Cancelling stops renewal; the current period runs to its end. If we discontinue the app or a subscription, renewals stop and Apple's refund policy applies to the current period.
- One-time purchases, when offered, unlock the features identified on the purchase screen in supported versions of the app. A one-time purchase is not a subscription, but it is not a promise of indefinite development, support, compatibility with future devices or operating systems, or continued App Store availability. If the app is discontinued, an installed copy may continue working while it remains compatible with your device and operating system, but continued operation, reinstallation, and future availability are not guaranteed. Refund eligibility is determined by Apple under its policies.
- Tips are optional in-app purchases that support the developer. A tip unlocks nothing, is not a donation to any charity or cause, and, like other consumable purchases, is refundable only at Apple's discretion.
- Restore Purchases in Settings restores subscriptions and non-consumable purchases made with the same Apple ID. Tips cannot be restored.
Prices may change; changes apply to renewals after Apple notifies you as its rules require. We may modify paid features for technical, legal, security, licensing, or product reasons. During a paid subscription period we will not intentionally remove substantially all of the core functionality represented as included in that subscription without an appropriate remedy where the law requires one.
6. Alerts
Nova, satellite, and event alerts are best-effort. They depend on public observation reports, third-party data feeds, Apple's push-notification service, and studio-operated services. An alert may be late or missed, and an event may be reported that does not pan out. Do not make plans that depend on receiving an alert.
7. Availability and changes
We may update, change, or discontinue any part of the app, its data feeds, or this website at any time. We may suspend access for misuse, including attempts to interfere with the app's services or other users. We may revise these terms prospectively. If a change materially affects your rights or obligations, we will give reasonable notice through the app, this website, or another appropriate method before it takes effect, and a change will not retroactively alter the rules for a dispute that arose before it. If you do not agree to revised terms, stop using the affected services.
8. Disclaimer of warranties
The app, its services, and this website are provided "as is" and "as available", with all faults. To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, title, and non-infringement. Some jurisdictions do not allow these exclusions, in which case they apply to the extent permitted.
9. Limitation of liability
To the maximum extent permitted by law, Dead Reckoning Studio LLC and its members, managers, employees, contractors, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to the app, its services, or this website. To the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the app, its services, this website, or these terms will not exceed the greater of the amount you paid through the App Store for the app or affected services in the twelve months before the event giving rise to the claim or US $50. These limits do not apply to fraud, willful misconduct, gross negligence, or death or personal injury to the extent liability cannot lawfully be excluded or limited, or to any other liability that applicable law does not permit us to limit.
10. Governing law
These terms, and any dispute between you and Dead Reckoning Studio LLC, are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Subject to any rights you cannot waive under applicable law, exclusive jurisdiction and venue lie in the state courts located in Douglas County, Colorado, or the United States District Court for the District of Colorado, except that you may bring an eligible individual claim in any small-claims court with jurisdiction. If you live outside the United States, this section does not deprive you of mandatory consumer protections or forums available under the law of your country of residence.
11. Entire agreement, waiver, and assignment
These terms, the Apple EULA, the privacy policy, and any transaction-specific terms shown by Apple are the whole agreement concerning the app, its related services, and this website. If any provision is unenforceable, it will be enforced to the greatest lawful extent and the rest remains in effect. A failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of the app or substantially all related assets.
